Moonshot's Kimi K3 Sparks Anthropic Fable Theft Accusation

A New Model Arrives Amid an IP-Theft Storm

China's Moonshot AI has landed at the center of two intertwined stories: the release of one of the most capable open-weight AI systems ever built, and a formal U.S. government accusation that the company stole from a rival lab to build it. On July 22, Michael Kratsios, director of the White House Office of Science and Technology Policy, said the administration has evidence that Moonshot AI "distilled" Anthropic's Fable model to help create its newly launched Kimi K3 system, calling the alleged conduct "large-scale, covert industrial distillation aimed at stealing proprietary U.S. technology" 37812.

Kratsios said Moonshot built a sophisticated internal platform capable of switching between multiple access methods specifically to evade detection while extracting capabilities from U.S. models 812. He also alleged that Moonshot had obtained servers equipped with Nvidia's advanced GB300 Blackwell systems and had accessed GB300 hardware in Thailand, raising the possibility that the company circumvented export controls to acquire chips barred from sale to China 1112. Treasury Secretary Scott Bessent quickly reinforced the warning, telling reporters that "open source is not open season on American IP" and that sanctions or Entity List designations remain on the table for firms conducting industrial-scale distillation 1112.

What Distillation Actually Means

Model distillation is a widely used and often legitimate technique in which a smaller "student" model is trained on the outputs of a larger, more capable "teacher" model, allowing developers to transfer some of a frontier system's abilities into a cheaper, more efficient package 1112. The dispute here is not over distillation itself but over whether Moonshot did it without authorization, at industrial scale, in order to harvest proprietary capabilities from a closed commercial system it wasn't permitted to use so extensively 811.

This is not the first time Moonshot has faced such allegations. In February, Anthropic said DeepSeek, Moonshot and MiniMax collectively generated more than 16 million interactions with Claude using roughly 24,000 fraudulent accounts, in violation of Anthropic's terms of service and regional access restrictions 131415. Piyush Sharma, CEO of the AI security firm Tuskira, said that when a model has learned to reason through software vulnerabilities and attack paths, copying its behavior can also copy that underlying analytical capability, a concern with direct relevance to national security 8. Congressional lawmakers have already opened a joint investigation into what they describe as a pattern of large-scale theft of American AI capabilities by Chinese labs and the subsequent redistribution of that capability through open-weight releases 8.

Kimi K3's Launch and Its Scale

Separate from the theft allegations, Kimi K3 itself is a significant technical release. Unveiled in mid-July, the model is a roughly 2.8-trillion-parameter mixture-of-experts system that Moonshot describes as achieving "open frontier intelligence," dwarfing other Chinese open models such as DeepSeek's 1.6-trillion-parameter V4 Pro and Zhipu AI's 744-billion-parameter GLM 5 series 69. It features a one-million-token context window and native multimodal understanding spanning text, images and video 1617. Moonshot released the full model weights on July 27, making K3 the first openly downloadable model in the three-trillion-parameter class 1720.

The timing was notable: the launch came roughly a month after Anthropic's Fable and Mythos models were abruptly withdrawn from the market by the U.S. government over unspecified cybersecurity concerns, and just hours before Chinese President Xi Jinping delivered a keynote at the World Artificial Intelligence Conference in Shanghai promoting open-source collaboration 7910. How K3 Actually Performs

Independent evaluators offer a more tempered picture. Artificial Analysis scored K3 at roughly 57 on its Intelligence Index, comparable to Opus 4.8 and GPT-5.5 but behind both Fable 5 and GPT-5.6 Sol 91719. On pricing, Artificial Analysis found K3's cost per task of about $0.94 undercut GPT-5.6 Sol's $1.04 and less than half of Opus 4.8's $1.80, though still notably pricier than other Chinese open-weight models 917.

Where K3 has clearly excelled is in narrower, task-specific arenas. On Arena.ai's Frontend Code Arena, K3 topped the leaderboard with roughly 1,679 Elo, surpassing Claude Fable 5 in blind human-preference testing across five of seven domains, trailing only in gaming 91020. Developer Guillermo Rauch highlighted that this marked the first time an open model had beaten every proprietary rival on a comprehensive web-engineering benchmark 17. The result is a story with two parallel and only partially reconciled threads: a genuinely capable, freely downloadable frontier-class model, and an unresolved allegation about how some of that capability was obtained.

The episode lands amid heightened anxiety in Washington over AI competition with Beijing.
